1. Object

3. Pricing

3.1. Under Portuguese legislation, all prices presented in the Mini Viana online store include the respective VAT rates in force.

3.9.3. If the actual price of the product is lower than the advertised price, Mini Viana will refund the difference.

3.9.4. If the price is higher, Mini Viana will inform the customer of this situation, by email or telephone, and will wait, for a period of 15 calendar days, counting from the date on which it was notified, for its decision to accept the new price or cancel the order.

3.9.5. Promotions advertised in the Mini Viana online store may not be applicable to physical stores and vice versa.

4. Orders

4.6. Data verification

4.6.1. After receiving the order, Garrafeira Soares reserves the right to confirm address, credibility and fraud verification data.

4.6.2. In relation to fraud checking, Mini Viana will carry out partially automated checks on all orders to filter unusual, suspicious transactions or those identified as susceptible to fraud.

4.7. Right not to accept the order or cancel the purchase

4.7.1. We reserve the right not to accept your order, or to cancel it even after automatic confirmation.

4.7.2. We also reserve the right to cancel any purchase, even if it has already been accepted by Mini Viana, particularly in the following situations:

- the product is no longer available/in stock (payments will be refunded);

- the billing information is not correct or verifiable;

- the order is flagged by our Security Systems as an incorrect order or an order susceptible to fraud;

- the transfer for payment of the order was not received by us within 5 working days after accepting your order;

- if there is evidence or information that you may not be of legal age to purchase or consume alcoholic beverages as permitted in your country of residence;

- in the event of an error in setting the price of the product;

- if it is not possible to deliver the order to the place/country indicated for that purpose.

4.7.3. In any of the above situations, Mini Viana will inform the customer via email.

4.7.4. If an order has been placed and payment has been made for products that are no longer available, Mini Viana will refund the amount paid for the unavailable items.

5. Payment

5.1. After confirming the order, an email will be sent to the contact address registered by the customer when formalizing, with all details about delivery, billing, payment information, products and values.

5.2. If the customer does not receive the order confirmation email, they are requested to contact Mini Viana via email: geral@miniviana.com or via telephone (+351)916 061 170 so that this notification can be again sent to the customer's email address.

5.3. Mini Viana asks all customers to confirm their details.

5.4. If any of the elements of the order are missing, incomplete, or incorrect, and/or the customer wishes to change any information, as long as the order has not yet been shipped, the customer is requested to contact us via email: geral @ miniviana.com or by phone (+351) 916 061 170 as soon as possible so that the requested change can be made internally.

5.5. Changes to the details of orders already shipped will have to be analyzed by the Mini Viana team so that, together with the customer, the most appropriate solution can be found.

5.6. All orders at Mini Viana will only be processed after effective receipt of payment, which must occur within a maximum period of 15 calendar days from the date of the order. After this period, the order will be automatically cancelled.

5.7. You can find the payment methods available in the Payment Methods section on the website. We do not accept any other payment methods other than those mentioned. Please do not attempt to pay by any other means than specified. If you do so, we cannot be held responsible for loss of payment or any other damages that may arise.

5.8. If you pay by Credit Card, we will deduct the amount due from your account as soon as your order is processed.

5.9. In the case of payment by Credit Card, all details (e.g. card number or expiration date) will be sent via encrypted protocol to the company that provides remote electronic payment services, without third parties having access to the information transmitted.

5.10. If you choose to pay by ATM Reference, Mini Viana will begin processing the order upon receipt of payment. This may take a few hours. Once 3 calendar days have passed after placing the order and if we have not received any payment, it will be cancelled.

5.11. This information will not be used by Mini Viana except to carry out the necessary procedures for the purchase or return, in the case of a return, in accordance with the exercise of the right to refund or for communication, to the competent authorities in case of suspected fraud.

6. Order Security

6.1. Mini Viana's online store uses encryption security technology.

6.2. Your payment information will be encrypted from the moment data is entered, until your transaction is processed, and will not be stored on a public server.

6.4. 7. Shipping and Delivery

7.0. With rare exceptions outside Mini Viana, all orders completed and paid by Credit Card, Multibanco Reference, PayPal or MBWAY*, will be dispatched on the same day, as long as payment has been made by 12:00 on a business day. Orders paid after this time will be dispatched on the following business day, with the exception of products that indicate limited stock.

The payment option by bank transfer* will have a confirmation period that may vary between 1 and 3 business days (depending on the country of origin of the transfer). In this payment method, Mini Viana has no control over the execution period of the banking transaction, which is the responsibility of the Customer's Bank. In these cases, the order will be dispatched on the day we receive confirmation of payment from the bank.

*The above-mentioned payment methods are not available in all countries.

If we have any questions related to the order (delivery address, payment confirmation, products out of stock, etc.), we will contact the customer through our Customer Support. We will wait for a response within three business days. The order will not be shipped until we receive a response to our message. If we do not receive any response within this period of time, we will cancel the order and refund the customer.

7.1. To send orders to the requested address, the shipping option must be chosen – National Shipping (in the case of Mainland Portugal and Islands) and International Shipping (in the case of other countries), as long as it is from a country mentioned in the list of countries available in the Order Shipping menu.

7.2. In general, after dispatch, an order at Mini Viana takes a while to be delivered to the order delivery address:

- 72 working hours in mainland Portugal;

- Between 5 and 12 working days on the Islands of Madeira and Azores;

- Around 4 working days in Peninsular Spain;

- Around 6 working days in the rest of Europe;

- Approximately 7 business days in the rest of the world.

7.3. The deadlines above are merely indicative and may vary depending on the payment method, see conditions below, as well as during periods of promotions, sales, Christmas or out of stock.

7.3.1. Mini Viana cannot be held responsible for delays in the delivery of orders during festive seasons (Sales, Carnival, Easter, Christmas, New Year's Eve) and the customer must, as a precaution, send an email to geral@miniviana.com to confirm whether the It will be delivered within the deadline stipulated on the website, www.miniviana.com.

7.4. Products will be delivered on working days, between 9am and 6pm. This service does not include scheduling or booking options, meaning delivery of the order will be made without prior contact from the carrier.

7.5. A delivery is considered made or a product is considered delivered with the signature of the delivery receipt at the address indicated by the consumer.

7.6. If the order is confirmed on a business day by 12pm and payment is made via Credit Card or via Paypal, the order will be sent on the following business day (weekends and holidays are not considered business days).

7.7. Payment by Multibanco reference may take between 5 and 7 days to be received, and only after payment confirmation will the shipment be processed.

7.8. Mini Viana cannot be held responsible for non-compliance with, or delay in meeting, delivery deadlines due to a force majeure event, that is, an event, act or omission, beyond its control.

7.9. Mini Viana is not responsible for shipments made to countries where the respective law does not allow the entry of alcoholic beverages.

7.10. It is the customers' responsibility to seize their orders, as well as pay customs fees, if applicable.

7.11. If products are returned, Mini Viana will only refund the corresponding amount. If you have any questions, you can contact Mini Viana before ordering.

7.12. Mini Viana has contracted services with specialized carriers for deliveries in Portugal, Europe and most countries in the world. Every effort is made to meet shipping and delivery deadlines, however, it should be noted that possible delays in deliveries may be beyond Mini viana's control, and it is not possible, in these cases, to guarantee exact delivery deadlines.

7.13. After orders have been dispatched, information for tracking shipping will be available in the account of customers who have placed the order with registration and a notification is also sent via email with information on the link for tracking shipping to all registered customers and not registered. 7.14. After shipping notification, customers must monitor the status of the shipment through the link provided by Mini Viana, so that they are aware of the progress until the moment the order is delivered, as Mini Viana does not notify each change. shipping status.

7.15. Partial Deliveries

7.15.1. If the order involves several products and Mini Viana is unable to ship them at once due to the unavailability of any of them, it will ship separately, with prior notice to the customer to the email indicated by the customer in the order.

7.16. Inspection upon delivery

7.16.1. All products sent by Mini Viana must be checked upon delivery.

7.16.2. If the customer finds that the order is damaged, they must immediately return it to the transport company, duly justify the reason for the return on the carrier's delivery note and immediately notify Mini Viana via email: geral @ miniviana .com or by calling (+351) 916 061 170.

7.16.3. Mini Viana will reimburse the amounts paid for the order and transportation as soon as the warehouse receives and completes the return process.

8. Failure to receive the order

8.1. If a delivery attempt by the transport company is unsuccessful due to absence, a notice will be left in the customer's mailbox with the carrier's details.

8.2. If for any reason the customer is unable to receive the order or pick it up at the location indicated by the carrier, they should contact Mini Viana so that the most appropriate solution can be found together.

8.3. Any complaint about non-receipt of an order must be made within a maximum period of 30 days from the date of placing the order. After this period, Mini Viana cannot be held responsible for the loss of the item.

9. Cancellation

9.1. Under current legislation, Mini Viana recognizes all its customers' right to terminate contracts signed with it, allowing them to return products within a period of 14 (fourteen) days.

9.2. Order cancellation before shipping

9.2.1. The customer can cancel the order, as long as it has not yet been shipped.

9.2.2. If the customer places an order and wishes to cancel it, they must:

- Check order status.

- If the order status says “Registered” there is a possibility that it will be cancelled, so you should contact our Customer Service and ask for it to be cancelled.

9.2.3. If the cancellation request is successful, the customer will be notified by email of this decision and the cancellation will be processed at no cost to the customer.

9.2.4. If the cancellation request is not possible, the products will be sent to the customer who, if he maintains his intention to cancel the order, must refuse to receive them.

9.2.5. The customer can always make a return according to the conditions and return rules mentioned below.

Returns
1. Return of products due to withdrawal
1.1. If for any reason you are not satisfied with the products, you can return them within 15 calendar days after receipt, as long as
the product is in perfect condition, and where applicable with its original packaging, accessories or promotional offers included, and accompanied by proof of purchase or invoice, and provided that it has not been tampered with in any way or by any means. In these cases, return shipping costs must be borne by the buyer.

2. Return of defective products
2.1. The customer has the right to return the delivered products if they are found to be defective. If this is confirmed by Mini Viana's specialized team, the product will be exchanged or returned at no cost to the customer.
2.2. Returns can be made within 15 calendar days after receipt of the order.
2.3. Mini Viana is not responsible for deficiencies resulting from incorrect use, negligence, poor storage conditions or causes of force majeure.
2.4. Once the merchandise has been received at Mini Viana's facilities and after validating its condition, the value will be refunded according to the payment method made by the customer.
2.5. You can also return your order to a selection of our own Mini Viana stores:
- To do this, you must ask an employee to carry out the process for you; or

- Do it directly through the website and then go to the selected store within 3 days to complete your return;

2.6. Mini Viana will refund or send the order, in the event of an exchange, and will be notified of the status of your order by email/sms.

Conditions applicable to Promotional Codes (discounts)
1. When used in accordance with the established rules, a promotion code entitles the user to take advantage of a promotion/discount relating to the purchase of a specific product or a set of products, during the period indicated/associated with the promotional code/campaign promotional.
2. Promotional codes can only be used for online purchases made on the website. The sale, exchange or donation of a promotional code is not permitted. The customer holding the promotional code may not upload or make a promotional code available on any website or other public form of offer, donation, sale or exchange. 4. The use of the promotional code is subject to only one use per product and per order. Promotional codes cannot be combined with any other promotions or special offers.
5. Promotional codes are not exchangeable/exchangeable for money.
6. Mini Viana has no obligation to reissue or refund promotional codes. However, if Mini Viana decides to reissue or refund a promotional code, you will need to have access to the initial promotional code. To do this, you must keep a copy of your promotional code, otherwise it cannot be reissued or replaced if lost.

Responsibility
Mini Viana will only be responsible for damages suffered by the customer in the event that such damages result directly from a breach of contractual obligations arising from Mini Viana's willful actions or gross negligence.

Applicable law
1. These general conditions and all emerging disputes that are related to these general conditions, including their validity, the use of the website or any purchase on it must be governed by Portuguese Law, namely by Decree-Law No. 24/ 2014, of February 14, with the change introduced by Law no. 47/2014, of 28/07.


2. All purchases made on the Mini Viana website are subject to Portuguese legislation and any conflict or divergence of interpretation of the General Conditions of Online Sale will be submitted to the competent Portuguese Court.
3. Under the terms and for the purposes of the provisions, it is informed that the available ADR entity is CIAB.
